The rule, exactly. Before an election each citizen chooses: to vote — or to take a payment and not vote in that election. The payment is a percentage of the median income, set by referendum; there is no fixed sum. One ballot is one vote, with no multiplier in the count; the vote is amplified only in that each ballot's share grows as others step out. The budget pays under law; a candidate never pays. Only a referendum of all citizens — simple majority, no quorum — introduces, changes or repeals the rule.

The protocol has been introduced nowhere and no pilot has been run: shares, turnout and outcome figures in the chapters are estimates, and the protocol promises nobody an election victory. If a chapter says otherwise, Exact Answers and the Charter are correct. For a candidate: ten questions and ten steps. For a citizen, a mayor, a finance officer, a donor, a journalist, a scholar, a lawyer: answers by role. Everything in force in one file: llms-full.txt.

40bn. Friedrich Hayek: Ten Theses — Price as the Aggregator of Knowledge, Nomos against Thesis, Demarchy by Types against the Protocol by States, and Three Blows

Chapter: 06 — The Structural Hypocrisy of Criticism and the Arsenal of the Elites File: 06_040bn · v1 · 28 October 2026 Source: the architect's question of 28 October 2026 ("what would Hayek say about AB-EXIT"). Friedrich Hayek: The Road to Serfdom (1944), "The Use of Knowledge in Society" (1945), The Constitution of Liberty (1960), "Competition as a Discovery Procedure" (1968), Law, Legislation and Liberty (vol. 1 Rules and Order, 1973; vol. 2 The Mirage of Social Justice, 1976; vol. 3 The Political Order of a Free People, 1979), the Nobel lecture "The Pretence of Knowledge" (1974). Before this chapter Hayek had in the repository 036b §6 (price as the aggregator of dispersed knowledge), 006 §15.20, 013e, 006b §3 (his model constitution in the list of predecessors), 040b §4–5 (Hanson strikes with Hayek — "disconnected sensors") and 040bk §4 (dispersed knowledge as one of the three limits on adaptation).

How to read. Hayek is the one thinker who holds at once the main argument for the protocol (price is the only working aggregator of dispersed knowledge) and the main suspicion against it (any designed institution is constructivism). The chapter checks ten of his theses by one yardstick — what is true today and what the protocol does with it — and examines three blows: constructivism, disconnected sensors, a new budget line.

1. Ten theses

No. Thesis (source) What is true today What the protocol does
1 Knowledge is dispersed across millions of heads; the only working aggregator is price (1945) The ballot is an aggregator without a price: one bit with no intensity and no stake The choice "D or weight" is a price; the share of takers is a number into which everyone's knowledge of what power is worth to him is compressed (036b §6)
2 Order is either grown (kosmos) or made (taxis); the result of the first cannot be designed (vol. 1, 1973) Reforms design the result: turnout, the composition of the hall, the "right" voter The protocol designs only the rule; who took and who stayed is a grown order that the architect does not know in advance (001: "what changes is not the rule but the response of millions to it")
3 Law (nomos) is an abstract general rule, known in advance and the same for all; a command (thesis) is a direction to particular people towards a particular end (vol. 1) Electoral law lives by commands: targeted packages, shifted dates, registers tailored to an election (057h) The charter is nomos in pure form: one formula, one right, fourteen articles that the elected do not change (048m art. 14)
4 The rule of law: equality before a general rule, no privileges to groups (1960) Indexation for the pensioner, a pre-election bonus for the public employee D is the same for every holder of the right (art. 4); the same as Buchanan's generality principle (040bm §1, thesis 4)
5 "The mirage of social justice": distribution by merit or need requires a judge who does not exist (vol. 2, 1976) Payments are targeted, by category, and the judge is the government D is not a social payment: not by need and not by merit, but for a choice; there is no judge — only the median from the tax body (art. 2)
6 Unlimited democracy degenerates into bargaining: the legislature buys the votes of groups with targeted benefits (vol. 3, 1979) This is the diagnosis of the present system, and Hayek made it first The protocol puts a ceiling and a receipt on the purchase of votes (1g; 040bm §2): one price, to all, in the open — instead of a thousand hidden ones
7 His own remedy — a model constitution: a legislative assembly elected by 45-year-olds for fifteen years, once in a lifetime ("demarchy", vol. 3) Adopted by no country in 47 years Hayek selected the hall by type (an age cohort); the protocol selects by state (a personal stake each cycle, art. 5). His aim is reached by his own instrument — a price, not a category
8 "Why the worst get on top" (1944, ch. 10): the demagogue gathers the most docile and undemanding, those easiest to persuade of "us against them" The demagogue's base is the apathetic and the media aimed at them (057h §2.4) That base leaves the hall first; those who stay value the vote above the money, and persuasion does not gather them (40bi §5)
9 Competition is a discovery procedure: the result is unknown in advance, otherwise competition is unnecessary (1968) Reforms promise the result ahead The protocol is a discovery procedure: the share of takers, p, the composition of the hall are learned, not assigned; courtyard → city → country (048l) — this is how Hayek said rules should be tested
10 "The pretence of knowledge" (1974): a planner with an exact figure is more dangerous than admitted ignorance Turnout figures, thresholds and quotas are assigned from above The protocol's only figure is the median, and it is not assigned but taken from the records (art. 2); p is adopted by referendum, not by a planner (art. 3)

2. The first blow: constructivism

The protocol was conceived by one person and is introduced at once; Hayek distrusted anything designed. The answer in three steps. First: Hayek himself drew the line — an order cannot be designed, the rules of the framework can and must be, and he wrote a model constitution himself (thesis 7). The protocol is a rule, not an order (thesis 2): it sets a formula and a right, and who will take and who will stay nobody knows, the architect included. Second: this is assembly, not invention (006b §3c): the secret ballot, the median, tax records, a payment to a card all exist already; only the link between them was assembled — and that, by Hayek, is how working rules arise. Third: the rule is adopted not from above but by a referendum of those it concerns, and changes only that way (art. 14); that is exactly what Hayek demanded of nomos — that it not be written by those who will rule under it.

3. The second blow: disconnected sensors

The blow has already been struck by Hanson in 040b §4: the farmer who took the money knows about the soil; the nurse, about the drugs; having bought their silence, the hall governs in a vacuum. The answer in 040b §5 was statistical: these people do not come anyway. The Hayekian answer is stronger. The ballot never carried that knowledge — one bit without intensity contains neither soil nor drugs. The farmer's knowledge works where Hayek found it — in the prices of his market. And in the hall a sensor appears that was not there: when the soil hurts enough, the farmer stays, and the share of takers in his district falls — that is the price that transmits knowledge (art. 9: the counter every day; 048k, decision 10: each level its own median). The sensor is not disconnected but priced: it is silent while the signal is weaker than D, and switches itself on when it is stronger. States, not types (1h).

4. The third blow: a new budget obligation is growth of the state

Hayek would suspect one more line of expenditure and one more recipient. The answer: it is not a new line but a ceiling over an existing hidden one (1g "A payment from taxes"); and the one line the elected can neither repeal nor redirect (040bm §5), that is, a constitutional constraint, not an expansion. From his own thesis 6: the bargaining for votes is already paid by the budget; the protocol only makes the price single and visible. The recipient is not new either: it is the same voter who is bought today with a package — only now he sees the sum and decides himself whether to take it.

5. What Hayek gives the protocol

The main word: the protocol for the first time brings into politics a price aggregator of the Hayekian type, and this is a mechanism, not a metaphor (thesis 1; 036b §6). The distinction between nomos and thesis as the name for "one formula against a thousand targeted packages". The diagnosis of bargaining democracy, made before Buchanan and Olson. The discovery procedure as the name for the pilot: not to prove the result but to learn it. And an admission he would have to make himself: his remedy, demarchy by age, was a solution by types, while the protocol solves the same task by states, with his own instrument — a price.

6. Summary

Thesis What is true Protocol What remains
price as the aggregator of knowledge yes the choice "D or weight" is a price; the share of takers its reading a transfer into a domain Hayek held closed to price (weak point)
kosmos and taxis yes the rule designed, the order grown —
nomos against thesis yes one formula, fourteen articles, untouched by the elected —
the rule of law yes D the same to everyone —
the mirage of social justice yes for a choice, not by need or merit —
bargaining democracy yes a ceiling and a receipt on the purchase of votes the cost is explicit, not zero (040bm, weak point)
demarchy not adopted the same aim by states, not by types —
the worst on top yes the demagogue's base leaves the hall first the core by habit — a measurement of 048l §4
discovery procedure yes courtyard → city → country —
the pretence of knowledge yes the median from the records, p by referendum —

Weak point

Hayek is paraphrased from the main works without quotations. He never claimed that elections can aggregate knowledge, so thesis 1 is a transfer of his mechanism into a domain he held closed to price; it is the repository's strongest argument and at the same time its most contestable place. The answer on sensors (§3) is reasoning, not a measurement: whether the farmer's "switching on" works under real pain only the pilot will show (048l §4). And the share of takers is the price of one good, power, not a vector of prices across all questions as in a market: it says how many people value the vote below D, but not what exactly hurts them.
